Ontario Dispute Adjudication for Construction Contracts (ODACC), which is the body created by the province’s authorized nominating authority for adjudicators under the Construction Act, now lists qualified adjudicators on its website.
According to the Council of Ontario Construction Associations, although more than 80 people have taken the prescribed adjudicator training courses, just 16 have received their qualifications. These people are lawyers, arbitrators, engineers and quantity surveyors. Their hourly rates range between $250 and $750, although under the terms of arrangements with ODACC, as much as half that fee is returned to the ODACC.
More are expected to earn their certifications as demand for their services under the new legislation grows.
ODACC is the organization created by ADR Chambers, which was named the province’s adjudication nominating authority earlier this fall. The organization’s website lists a number of resources for those with questions about the adjudication process. The Frequently Asked Questions page, for example, explains how parties can begin adjudication processes, respond to notices of adjudication, as well as the process followed during adjudication—and more.
Further resources are available for claimants, respondents and adjudicators.
